A Federal High Court in Abuja has discharged and acquitted suspended Deputy Commissioner of Police Abba Kyari in the asset declaration case filed against him by the National Drug Law Enforcement Agency.
The ruling was delivered on Thursday by Justice James Omotosho who held that the prosecution failed to prove the allegations contained in the 23 count charge brought against Kyari and his two brothers Mohammed Kyari and Ali Kyari.
The NDLEA had accused the former head of the Police Intelligence Response Team of failing to properly declare several assets and disguising ownership of properties allegedly linked to him. The agency also alleged that some funds connected to the properties were hidden through bank accounts and other financial arrangements.
During the trial the anti narcotics agency presented witnesses and documentary evidence to support the charges. However the court ruled that the prosecution did not establish its case beyond reasonable doubt. Justice Omotosho therefore dismissed the charges and discharged the defendants.
The judgment brings an end to the asset declaration case that has been part of the broader legal battle involving the suspended police officer. Kyari still faces other legal proceedings related to alleged drug trafficking which are being handled separately in court.
